D-Day set for May 14th

Recieved email from Haringey licensing

Dear Residents/ Interested Parties,

I attach a letter notifying of the date of the hearing which has now been re-arranged.

Please note that I am sending this notification well ahead of the time required under the Licensing Act 2003. Please note the same principles apply in that only those that have made relevant representation and a relevant representation within the consultation period may speak at the hearing.

It would be helpful if you were to organise yourselves so that you identify people who will speak on your behalf and represent your views to the Committee.

Those wishing to speak will sign a form prior to the start of the meeting to indicate who they are and which side they represent. I will ensure that I will be cross referencing the forms filled in with the letters that have made it into the report.

Be aware that the applicants solicitor does not have to agree with the bundle of letters that I say are valid.

Residents should also note that the meeting will take place in the Council Chambers and as such it will be web-cast and available for viewing.

The report will be available for viewing in early May.

INFORMATION ABOUT THE HEARING

Rights of Parties

Any party may attend the hearing and may be assisted or represented by any person whether or not that person is legally qualified.

At the hearing a party shall be entitled to:

(i) give further information in support of their application or representations (as applicable) in response to a point on which the Council has given notice that it will want clarification,

(ii) question any other party if permitted by the Council, and

(iii) address the Council (i.e. the Committee or Sub-Committee hearing the matter)

Consequences of Not Attending the Hearing

If a party does not attend the hearing or is not represented at the hearing, the Council may either:

(a) adjourn the hearing to a specified date, or

(b) hold the hearing in the party’s absence.

Procedure at Hearing

The Licensing Procedure Rules governing the hearing are attached.

Please inform the Licensing Service as soon as possible if you intend to:

Call a witness to give evidence in support of your case, or

Produce any documentary evidence in support of your case.
